Terms of Service

Last updated: October 2026

Scope

These General Terms and Conditions (hereinafter "Terms") apply to all contracts regarding the use of the platform "WITH THIS LINK" (hereinafter "Platform") concluded between the operator of the Platform (see Legal Notice) and the users.

The Platform enables registered users to create, customize, and share digital invitations via a link.

Deviating, conflicting, or supplementary general terms and conditions of the user shall not become part of the contract unless their validity is expressly agreed to.

Services

Description of Services

The Platform offers the following services:

  • Creation and management of digital invitations
  • Customization of invitations (text, images, designs)
  • Generation of shareable links for invitations
  • RSVP / guest responses (collection and management of guest replies)
  • Storage of invitation data

Availability

We strive for maximum availability of the Platform. However, we cannot guarantee 100% availability. In particular, maintenance work, security, or capacity reasons may lead to temporary disruptions.

Changes to Services

We may expand the scope of services and offer new features. We change or restrict existing services only where there is a valid reason, such as a change in the law, technical requirements, or security reasons, and the change is reasonable for the user taking our interests into account. The user incurs no additional costs as a result. If a change impairs access to or the usability of a paid service more than insignificantly, we inform the user at least four weeks in advance by email about the features and the date of the change. The user may then end the contract for that service free of charge within 30 days of receiving the information or, if later, of the change (Section 327r BGB, German Civil Code). This does not apply if we continue to provide the unchanged service without additional costs.

Registration and Contract

Registration

Registration is required to use the Platform. Truthful and complete information must be provided during registration. The user is obligated to keep their data up to date.

Registration is only permitted for natural persons who have reached the age of 18 and have full legal capacity.

Conclusion of Contract

By registering, the user makes a binding offer to conclude a usage agreement. We may accept this offer by sending a confirmation email or by activating access.

Access and Credentials

The user is obligated to keep their access credentials confidential and to protect them from access by third parties.

User Obligations

Permitted Use

The user agrees to use the Platform exclusively for lawful purposes. In particular, it is prohibited to:

  • Violate the rights of third parties (copyrights, trademark rights, personal rights)
  • Distribute content that violates legal regulations
  • Publish harassing, defamatory, or obscene content
  • Add pornographic content
  • Add sexualized depictions of minors, in particular child or youth sexual abuse material (Sections 184b and 184c StGB, German Criminal Code)
  • Add content that incites hatred or violence against people or groups, in particular incitement to hatred (Section 130 StGB), or extremist content such as propaganda material and symbols of unconstitutional or terrorist organizations (Sections 86 and 86a StGB)
  • Distribute viruses, trojans, or other harmful software
  • Use the Platform in a way that impairs its functionality

Liability for Own Content

The user is solely responsible for the content they create and upload.

The user warrants that they hold all rights to the content they add and that, for personal data of third parties contained in or revealed by that content, they have the necessary legal basis, in particular the consent of the data subjects concerned. This also applies to special categories of personal data within the meaning of Art. 9(1) GDPR (such as information revealing religious beliefs, health, or ethnic origin).

Indemnification

The user shall indemnify us against all claims that third parties assert against us because of an unlawful use of the Platform or a violation of these Terms for which the user is responsible, including a breach of the above warranties regarding rights to the content they add and the necessary consents of the data subjects concerned. The indemnification also covers the necessary costs of our legal defense, but attorney fees only up to the amount of the statutory fees. We inform the user without undue delay when a third party asserts such claims, give them the opportunity to comment, and do not acknowledge such claims without their consent.

Measures in Case of Violations

If we become aware of illegal content or content that violates these Terms, we may block or remove that content without prior notice and end the publication of the invitation concerned. In doing so, we take into account the seriousness of the violation and the legitimate interests of the user and choose the mildest suitable measure. We give the user concerned the reasons for every measure by email, at the latest when it is carried out, and tell them how they can contest it (Article 17 of Regulation (EU) 2022/2065, Digital Services Act). A natural person decides on measures; the only automated step is the hash matching described in the "Photo Albums" section. In case of serious or repeated violations, we may temporarily suspend the user account or terminate the usage agreement for good cause. We announce a suspension of the account in advance and give the user the opportunity to comment; where immediate action is required, in particular in the case of criminal offenses or to avert serious danger to third parties, we obtain the comment without undue delay afterwards. We lift the suspension as soon as the reason for it no longer exists. Statutory claims of both parties remain unaffected. For photo albums, the "Photo Albums" section additionally applies.

If a criminal offense is suspected, we may report the matter to the competent law enforcement authorities and provide them with the content concerned and the information about the user needed to investigate it. Where information known to us gives rise to a suspicion of a criminal offense involving a threat to the life or safety of a person, we are obliged to do so (Article 18 of Regulation (EU) 2022/2065).

Photo Albums

Photo Album Add-On

As a paid add-on, the user can upload photos and videos of their event to an album linked to a published invitation and share it with their guests via the invitation link and an access code. Guests can view and download the album. The user who owns the album (hereinafter "album owner") can allow other registered users (hereinafter "contributors") to upload files to the album as well.

Responsibility for Album Content

The album owner decides which photos and videos they upload, which contributors they admit, and with whom the album is shared. How we process the album files as controller is described in our Privacy Policy. The album owner warrants that they hold the necessary rights to every file they upload themselves, in particular the copyright and the consents of the people shown that the right to one's own image (Sections 22 and 23 KUG, German Art Copyright Act) requires, that they inform their guests about the sharing of the photos and videos, and that no file contains illegal content. The obligations and the indemnification under "User Obligations" apply accordingly. Each file is the responsibility of the user who uploaded it.

Storage, Delivery, and Retention

Original files are stored exactly as uploaded, including embedded metadata such as EXIF data and GPS location; anyone who downloads an original file also receives this metadata. Files are delivered through a content delivery network (CDN) under long, random addresses. The access code protects the album listing, not the individual files: anyone who knows a file's address can open it directly. Up to 12 photos the album owner chooses as highlights are shown on the invitation itself, without the access code.

The relevant event date is the date of the invitation through which the album is activated, as it stands 14 days after that invitation was first published; later changes to the date on the invitation do not change the album's periods; after that, only our support can adjust the album's event date. Uploads are possible until 90 days after the event date or, if the activation is later, until 90 days after the activation, but never beyond the album's expiry. The album expires at the earlier of one year after the event date or 540 days after its activation. After it expires, guests can no longer open the album; individual files remain reachable at their addresses until deletion. 30 days after expiry we delete the album and all of its files. The album is not a backup; the album owner and the contributors keep their own copies of their files.

Contributions from Other Users

If the album owner has turned on contributions for their album, a registered user can ask them for permission to upload photos and videos to it. With the request, they expressly accept the grants of rights and warranties in this section; a request is not possible without this acceptance. The album owner accepts or declines the request and can mark a contributor as trusted. Files from trusted contributors appear in the album without review; the album owner reviews all other contributions before they appear in the album for guests. If the album owner rejects a contribution, the file is removed from the album at once and deleted from storage shortly after. Contributions count toward the album's storage, including while they await review; the album owner can set how much storage a contributor may use. Contributors have the same upload window as the album owner, as long as the album owner keeps contributions turned on; once turned off, no new requests or uploads are possible. Guests are not shown who uploaded a file; the album owner can see it for files awaiting their review.

Rights to Contributions

By this acceptance, the contributor grants the album owner, for every file they upload to the album, a simple (non-exclusive), royalty-free right of use to store, display, and share the file with others for private purposes, in particular with the guests of the event via the album and as a highlight on the invitation. The copyright itself remains with the author; it cannot be transferred (Section 29(1) UrhG, German Copyright Act). The contributor also grants us, for every uploaded file, the right described under "Rights to User Content" in the "Intellectual Property" section, to the extent necessary to provide the album to the album owner and their guests.

The contributor can delete their own files at any time until the album expires; the album owner can delete any file in their album. Both rights of use for a file end as soon as the file is deleted, in particular when the contributor deletes it. Deleting the contributor's account does not end them: if the contributor deletes their account, their files remain in the album, and we remove the link between the files and their account. Anyone who does not want their files to remain in the album deletes them before deleting their account. All contributions are deleted together with the album. We have no access to copies downloaded before a deletion.

Contributor Warranties

By this acceptance, the contributor warrants that they hold the rights required for the above rights of use to every file they upload, in particular the copyright or the author's permission and the consents of the people shown that the right to one's own image (Sections 22 and 23 KUG) requires, and that no file contains illegal content. The obligations and the indemnification under "User Obligations" apply accordingly. People shown can object to the publication of a file via our report form (see "Reports and Takedown").

Reports and Takedown

Anyone can report an invitation or a photo album via our report form, without an account; the "Report" link on the invitation and the album page leads there. We review reports and may, in accordance with the "User Obligations" section, block or remove individual files and take down an entire album. A taken-down album is no longer available to guests, and the album owner sees the reason for the takedown in their account. We delete its files, including contributions, 14 days after the takedown unless we lift the takedown before then, for example after the album owner has commented. Illegal content, in particular abuse material, we remove at once. If we remove individual files, we inform the user who uploaded them of the reasons by email. Statutory claims remain unaffected.

Detection of Abuse Material

Files are delivered through Cloudflare, which compares images cached in its network against known child sexual abuse material by hash matching, blocks the address of a match and notifies us. This is detection after upload, not prevention: it cannot identify every such file and does not relieve the user of their responsibility for the content they upload. Where required by law, matches may be reported to competent authorities or organizations. The same applies to all other images delivered through the CDN, including the images of an invitation.

Pricing and Payment

Prices and Credits

The user account and access to the Platform are free of charge. To publish invitations, invitation credits can be purchased for a one-time payment. This is a one-time purchase with no recurring subscription. The prices displayed during the order process are decisive and are final prices. Any value-added tax is shown by Polar as Merchant of Record.

Duration of Published Invitations

An invitation credit keeps an invitation online until one year after its first publication or one year after its event date, whichever is later, but no longer than three years after its first publication. The event date is the date as fixed 14 days after the first publication or as adjusted by our support. After that, the invitation's link shows that it has expired; the user can keep editing it until they delete it. Publishing it again does not extend this period.

Payment Terms

Payment is processed through Polar (Polar Software Inc.), which acts as Merchant of Record (seller in its own name). Polar handles payment and shows or remits any value-added or sales tax that may apply under the relevant tax rules in its own name; any such tax is shown by Polar, not by the operator. The payment terms of Polar additionally apply. Payments are due immediately upon service delivery.

Right of Withdrawal

Consumers have a statutory right of withdrawal when purchasing invitation credits and photo albums (including album upgrades) for a fee. For invitation credits, as the service is provided in digital form, the right of withdrawal may expire prematurely if the consumer expressly consents to performance beginning before the expiry of the withdrawal period and acknowledges the resulting loss of the right of withdrawal. For the photo album, a digital service, the right of withdrawal does not expire when performance begins; if the consumer requests that the service begin during the withdrawal period and then withdraws, they must pay a reasonable amount corresponding to the proportion of the service already provided up to the withdrawal, compared to the total scope of the service provided for in the contract. By way of exception, if an order includes invitation credits and a photo album and the consumer withdraws only from the contract for the photo album, we refund the share of the price attributable to the photo album in full, without deducting a reasonable amount; this share equals the standalone price of the 15 GB photo album as shown on our pricing page at the time of the order. The details and the precise conditions are set out in our Cancellation Policy.

Intellectual Property

Rights to the Platform

All rights to the Platform, including its design, software, and provided content, remain with us or our licensors.

Rights to User Content

The user grants us a simple (non-exclusive) right to store, process, and use the content uploaded by them, to the extent necessary to provide and operate the services requested by the user (in particular to display the invitation via the shared link). We may pass on this right to service providers engaged by us (e.g. hosting and storage providers) to the extent necessary to operate the Platform. It ends upon deletion of the content or the user account, unless statutory retention obligations require otherwise. For files a user uploads as a contributor to another user's photo album, the scope and end of this right are governed by the "Photo Albums" section.

Liability

Scope of Liability

We are liable without limitation for intent and gross negligence, for damages arising from injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), and to the extent of any guarantee we have given.

In case of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal obligations). These are obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance the user may regularly rely. In that case, our liability is limited in amount to the foreseeable, contract-typical damage at the time of contract conclusion. Otherwise, our liability for slight negligence is excluded.

Where our liability is limited or excluded, this also applies to the personal liability of our employees and vicarious agents.

Data Loss

We strive to securely store user data. We are liable for the loss of data in accordance with the liability provisions above. The user is responsible for separately backing up content important to them. In case of slight negligence, our liability for the restoration of data is limited to the effort that would have been required had the user properly backed up their data.

Term and Termination

User Account and Closure

The free user account exists for an indefinite period. The user may delete it themselves at any time. We may terminate the usage agreement by email with four weeks' notice, but not while an invitation of the user is still online under the "Pricing and Payment" section or a photo album has not yet expired under the "Photo Albums" section, and not while the user has unused invitation credits, unless we refund them first. Purchased invitation credits are a one-time purchase and do not constitute a recurring subscription. The statutory right of withdrawal for the paid purchase is governed by our Cancellation Policy.

Extraordinary Termination

The right to extraordinary termination for good cause remains unaffected.

Consequences of Termination

Upon termination of the contract, the right of use expires. Access to the Platform will be blocked. User content will be deleted in accordance with our Privacy Policy. Files the user uploaded as a contributor to another user's photo album remain in that album as set out in the "Photo Albums" section.

Data Protection

We process personal data of users in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). For details on data processing, please refer to our Privacy Policy.

Where you have given your consent, we also use usage analytics to improve the Platform. Details on this and on how to withdraw your consent at any time can be found in our Privacy Policy.

Changes to Terms

We may amend these Terms with effect for the future where there is a valid reason, in particular a change in the law or in the case law of the highest courts, the introduction of new features, or closing a gap in the provisions that arose after the contract was concluded.

We notify the user of every amendment at least four weeks before it takes effect by email to the address stored in their account, together with the new wording and the date on which it takes effect.

Amendments that concern neither the type and scope of the services, prices, durations, and periods nor the balance between performance and consideration, and that do not unreasonably disadvantage the user, such as editorial changes or provisions for new, optional features, provided these leave the existing services and the user's obligations unchanged, take effect on the notified date unless the user objects to them before then. The notice separately points out the right to object, the deadline, and the consequences of not objecting. No particular form is required for the objection; an email to the address named in the notice is sufficient. If the user objects, the previous version continues to apply to them. Regardless of this, they can delete their user account at any time.

All other amendments take effect only if the user expressly agrees to them. Silence or merely continuing to use the Platform does not count as agreement. If the user does not agree, the previous version continues to apply to them.

Dispute Resolution

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

Final Provisions

Applicable Law

The law of the Federal Republic of Germany shall apply to all legal relationships between us and the user, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Where the user acts as a consumer, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by the mandatory provisions of the law of the country in which the consumer has their habitual residence (Article 6(2) of the Rome I Regulation).

Place of Jurisdiction

If the user is a merchant (Kaufmann), the exclusive place of jurisdiction for all disputes arising from the contractual relationship is Berlin; we may also sue the user at their general place of jurisdiction. The same applies to users who are not consumers and have no general place of jurisdiction in Germany, and where the user, after the contract is concluded, moves their domicile or habitual residence out of Germany or their domicile or habitual residence is unknown at the time the action is filed. For consumers, the statutory places of jurisdiction apply; we sue a consumer domiciled in the European Union only at their place of domicile.

Severability Clause

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.

Language

These Terms are drafted in German. Insofar as translations in other languages are provided, the German version shall prevail in case of dispute.
